Judge denies Mexican tomato growers’ request for duty relief

A federal judge last week denied a request from Mexican tomato growers for an injunction against duties the U.S. recently began assessing after the Commerce Department withdrew from a suspension agreement with Mexico covering fresh tomatoes. In a case filed with the Court of International Trade last month, Mexican tomato growers accused Commerce of unlawfully withdrawing from the agreement and requested an injunction against duties that were re-imposed following the withdrawal in early May.
